  1. Outline of this Privacy Policy

    1. Midnight London Ltd (the Company, we, us and our) is committed to protecting the personal information of all:

      1. its customers; and

      2. users of its mobile application software (App) (together, its Users).

    2. This privacy policy will help Users understand how and why the Company collects information, how that information is stored, how they can access and correct that information and when we might disclose information to third parties.

    3. This privacy policy does not limit or exclude any rights that a User has or may have under the Data Protection Act 2018 (DPA) or the General Data Protection Regulation 2016/679 (GDPR).

  2. Application of this Privacy Policy

    1. This privacy policy applies to all instances in which personal information is collected from a User by the Company.

    2. By using the App and accessing the Company’s platform, including but not limited to the Company’s:

      1. iPhone application;

      2. Android application;

      3. website, being thenightlifecard.com (Website); or

      4. any other platform that may be introduced in the future, (altogether, the Platform)

        which allows Users to connect to the services offered by the Company (Services), the User consents to the collection, use, disclosure, storage and processing of personal information in accordance with this privacy policy.


  3. Changes to this Policy

    1. The Company may change this policy at any time by uploading a revised privacy policy to the App and/or to its Website.

    2. All Users agree to be bound by the privacy policy that is in effect at the time they use the Services.

    3. The Company will send notification of any such changes or amends of this privacy policy to Users’ accounts and/or registered email addresses.


  4. Collection of Personal Information

    1. The Company will collect the following personal information:

      1. Any communication with the Company either directly, via phone or email.

      2. Information obtained by or submitted to the Company from the User through that User's use (or prospective use) of the Services.

    2. The Company may supplement the information provided to it with information it receives from third parties.

    3. It is the responsibility of the User to promptly notify the Company of any changes to their personal information in order to ensure that it remains true, accurate, current and complete.


  5. Personal Information that may be Collected

    1. Users are not anonymous to the Company when they log into or access the Platform and/or use the Services.

    2. The Company may, in addition to other information, collect the following information about a User:

      1. The User's name, phone number, residential address and email address.

      2. The User's gender and date of birth.

      3. The User’s employer and team.

      4. The Users travel movements (including regularity of travel and distance travelled), emissions statistics, and other travel-related and emissions-related information.

      5. Information about the User’s use of our Services, including comments, reactions, codes, competition results, awards, good deeds, and other use-related information.

    3. If any User chooses not to provide information when we ask for it, they may not be able to use the Services.


  6. Use of Personal Information

    1. The information that Users provide to the Company may be used:

      1. to verify the identity of the User;

      2. in connection with the provision (or potential provision) of the Services to the User;

      3. to communicate with Users in relation to the Services;

      4. to market our Services to Users, including contacting Users electronically (for example, by text, email or an online messaging platform);

      5. to undertake credit checks of any User (if necessary);

      6. to invoice any User and to collect money that a User owes to us, including authorising and processing credit or debit card transactions;

      7. to respond to communications from a User, including any complaints;

      8. to co-operate with any government, industry or regulatory authorities;

      9. to protect and/or enforce our legal rights and interests, including defending any claim; or

      10. for any other purpose authorised by a User and/or the DPA.

    2. The Company reserves the right to use data (on a strictly anonymous basis) in relation to Users' use of the Services for marketing and accounting purposes.

    3. Users may request the Company to stop sending marketing messages at any time, by contacting the Company on support@thenightlifecard.com.


  7. Cookies

    1. The Company uses cookies (being an alphanumeric identifier that we transfer to your computer’s hard drive so that we can recognise your browser) in order to monitor your use of the App or Website.


  8. Disclosure of Information

    1. Unless expressly authorised to do so by the relevant User or under this privacy policy, the Company will not disclose any User's personal information to any third party except where disclosure relates to the purposes for which the information was collected (as stated in clause 6.1 above).

    2. The Company does not in any way control, and does not accept any responsibility or liability whatsoever for, the disclosure or use of personal information which is voluntarily posted by Users in any publicly accessible area of the Platform.


  9. Protection and Retention of Personal Information

    1. The Company will take all reasonable steps to ensure the personal information collected, used or disclosed in accordance with this privacy policy is stored in a secure environment (including on Google’s cloud infrastructure), protected from unauthorised access, modification or disclosure.

    2. The Company will hold personal information collected in accordance with this privacy policy both before and after the provision of its Services in order to fulfil the purposes for which it was collected, but only for so long as we are legally entitled to do so.

    3. Users are responsible for keeping their account login information, including email address and password, secret and secure. Without limiting the foregoing, Users agree:

      1. not to permit any other person to use their username or account; and

      2. not to disclose, or provide to any other person, their password, email address, date of birth or any other information in connection with the User’s account that may allow them to gain access to their account.


  10. Third Parties

    1. The Platform may contain links to third party websites, including the networks of the Company’s valued affiliate service providers and advertisers.

    2. The Platform may also make available certain services obtained from third parties, including verification services by third party verification providers.

    3. If Users use the Platform to link to another site or app, or use a service obtained from a third party service provider via the Platform, the Users will be subject to that site, app, or third party’s terms and conditions of use, privacy policy and/or security statement.


  11. Legal Rights and Access to Personal Information

    1. Users have the following rights in relation to their personal information:

      1. To request access to their personal information.

      2. To request a correction to their personal information.

      3. To request the deletion or removal of their personal information.

      4. To object to the processing of their personal information.

      5. To request a restriction on the processing of their personal information.

      6. To request a transfer or their personal information to you or a third party.

      7. To withdraw consent to the use of their personal information.

  12. Severability

    1. If any part of this privacy policy is found by a court to be invalid, void or unenforceable, whether under the DPA, GDPR, or any other applicable law, such provision will be deemed to be deleted from this privacy policy and the remaining provisions of will continue in full force and effect.
